These Terms of Service (“Terms”) govern your use of our website at diptait.com.bd and all services provided by DIPTAIT, including web development, app development, e-commerce solutions, and other IT services. By accessing our website or engaging our services, you agree to be bound by these Terms.

By accessing or using our website and services, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use our website or engage our services. We reserve the right to modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.

Services Description

DIPTAIT provides the following IT services to businesses and individuals in Bangladesh and internationally:

• Custom Web Development: Bespoke websites built with modern technologies including Next.js, React, and Tailwind CSS.
• Android App Development: Native and cross-platform mobile applications for Android devices.
• iOS App Development: Native and cross-platform mobile applications for Apple devices.
• E-Commerce Solutions: Online store development with bKash, Nagad, and other payment gateway integrations.
• UI/UX Design: User interface and experience design tailored to your brand and audience.
• Website Maintenance: Ongoing support, updates, and hosting management.

The specific scope, deliverables, and timelines for each project are agreed upon between DIPTAIT and the client before work begins.

Pricing & Payment

All pricing is discussed and agreed upon before project commencement. Payment terms are as follows:

• An advance payment (typically 50%) is required before work begins, unless otherwise agreed.
• The remaining balance is due upon project completion and before final delivery of files or deployment.
• Payments can be made via bKash, Nagad, bank transfer, or other methods agreed upon by both parties.
• All prices are quoted in Bangladeshi Taka (BDT/৳) unless otherwise specified.
• Additional features or changes outside the original project scope may incur additional charges, which will be communicated and approved before implementation.

Project Delivery

We strive to deliver all projects within the agreed-upon timeline. However, delivery timelines are estimates and may vary depending on:

• The complexity and scope of the project.
• Timeliness of client feedback and content delivery.
• Changes or additions to the original project scope.
• Unforeseen technical challenges.

DIPTAIT will communicate any significant delays and work with the client to establish revised timelines. The client is responsible for providing all required content, assets, and feedback in a timely manner to ensure on-time delivery.

Intellectual Property

Upon full payment, the client receives complete ownership of the custom code, design files, and content created specifically for their project. This includes:

• Custom source code written for the project.
• Design mockups and visual assets created for the project.
• Content written specifically for the client's website or application.

The following remain the property of DIPTAIT or their respective owners:

• Proprietary tools, frameworks, and reusable components developed by DIPTAIT.
• Third-party libraries, fonts, and open-source software used in the project (governed by their respective licenses).
• DIPTAIT retains the right to showcase completed projects in our portfolio unless the client requests otherwise in writing.

Limitation of Liability

To the maximum extent permitted by applicable law, DIPTAIT shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services, including but not limited to:

• Loss of profits, revenue, data, or business opportunities.
• Service interruptions, downtime, or data loss caused by third-party hosting providers.
• Security breaches resulting from client-side vulnerabilities or third-party services.
• Damages resulting from unauthorized modifications to delivered work by the client or third parties.

Our total liability for any claim related to our services shall not exceed the total amount paid by the client for the specific project in question.

Refunds & Cancellations

Our refund and cancellation policy is as follows:

• Before work begins: If a project is cancelled before any work has commenced, a full refund of any advance payment will be issued.
• After work has begun: If a project is cancelled after work has started, the advance payment is non-refundable as it covers time and resources already allocated. A partial refund may be considered based on the percentage of work completed.
• Completed projects: No refunds are issued for completed and delivered projects that meet the agreed-upon specifications.
• Disputes: If you are unsatisfied with the delivered work, we will work with you to make reasonable revisions within the original project scope at no additional cost.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the People's Republic of Bangladesh. Any disputes arising from or related to these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Dhaka, Bangladesh. Both parties agree to attempt to resolve any disputes through good-faith negotiation before pursuing formal legal action.
